The Sixth seminar from the training programme in International Judicial Cooperation “Transfer of Sentenced Persons” held in Podgorica by EURoL2

PODGORICA – 28th-29th March 2019 – EURoL 2 in cooperation with the Centre for Training in Judiciary and State Prosecution (JCT) and the Ministry of Justice, organised the seminar on the topic of Transfer of Sentenced Persons. The seminar held in the JTC premises was attended by 30 participants and it covered the topic related to obligations of the State Parties to the Convention and the Protocols, Conditions for transfer, requests and replies, supporting documents. Particular focus was on : International Convention on the Transfer of Sentenced Persons (ETS No. 112); Additional Protocol to the Convention on the Transfer of Sentenced Persons (ETS No. 167) and its importance for improving the legislative framework ; Regulations on the transfer of prisoners adopted by the European Union : Framework Decision 2008/909/JHA on the application of the principle of mutual recognition for judgments imposing custodial sentences or measures involving deprivation of liberty.

Ms Senka Danilovic, President of the Steering Committee of the Centre for Training in Judiciary and State Prosecution and Eurol 2 DTL Maria Grazia Benedetti welcomed all the participants, underlining the importance of the trainings related to the International Judicial Cooperation and in particular active cooperation of Montenegrin institutions in with the EU colleagues and EU institutions related to international judicial cooperation. Also, in the opening remarks they supported the use of local and international experts as it was the case in previous trainings. During the seminar in his intervention Mr Nikola Saranovic, General Director for International Judicial Cooperation and Projects of the Ministry of Justice,  underlining the excellent cooperation with the EURoL 2 and support received by the project, presented  the activities of the Ministry of Justice related to judicial cooperation explained the aim of the new draft of the ratification of the Protocol Amending the Additional Protocol to the Convention on the Transfer of Sentenced Persons and its Explanatory report.

The seminar on Transfer of Sentenced Persons is the second out of 6 planned seminars for 2019 ( previously in 2018 we had four trainings) from the Training Programme in the area of International Judicial Cooperation in civil and criminal matters, which will contribute to the improvement of knowledge of judges, prosecutors and police officers in the implementation of EU instruments in the area of international judicial cooperation, supporting  Montenegro in the process of  the accession to EU.

Speakers at the training were Mr. Stefano Opilio, Head of the Unit for International Judicial Cooperation in criminal matters, Ministry of Justice of Italy, Mr. Antonio Pastore, Magistrate attached at the Unit for International Judicial Cooperation in criminal matters, Ministry of Justice, Mr. Vlado Novovic, Judge of the High Court in Podgorica and Mr Nikola Saranovic, General Director for International Judicial Cooperation and Projects of the Ministry of Justice. Practices of international assistance and case studies have been presented and discussed with participants by the international and national experts.
